The Judicial Board of the University of Ghana Students Representative Council has nullified the election of Emmanuel Owusu Ampem as the Speaker for the SRC General Assembly.
This comes after level 400 student of the University, Delvin Addae, petitioned it to quash the Speakership election, claiming that it was wrought with irregularities.
Counsel for the petitioner, Daniel Kofi Kyere-Nkrumah, argued that by reason of wrongful constitutional interpretation given to Article 6 of the SRC constitution, certain groups of students who were not eligible to vote on the day of the election.
“WHEREFORE the plaintiff claims against the defendants for: –
A declaration that the purported General Assembly Chairperson results declared by the Electoral commission is/was tainted with irregularities”
“A declaration that a group of students purporting to be members of the General Assembly voted in to General Assembly Chairperson elections.
“An order to quash the General Assembly Chairperson elections results declared by the electoral commission”.
“A declaration that decision by the Electoral Commission is ultra vires and as such void ab initio and of no effect whatsoever”.
Speaking to UniversNews after the hearing, Daniel Kofi Kyere-Nkrumah welcomed the ruling.
Daniel Kofi-Kyere-Nkrumah also expressed worry about the absence of the SRC President, Isaac Agyemang, and the EC’s legal advisor, Prosper Batariwah, at the hearing.
Tuesday’s ruling implies that another election must be organized by the SRC Electoral Commission to elect a Speaker for the General Assembly.
The ruling also implies all sittings presided by Emmanuel Ampem Owusu Adjei, as well as resolutions made at these sittings, is also null and void.
Emmanuel Owusu Adjei has already chaired three General Assembly sittings.
At these meetings, the SRC budget for the semester as well as its projects and programmes have been approved.
Also, Committee heads have been approved.
Are there financial implications too?
In a budget presented to the now-defunct General Assembly, GHC 12,000 is to be used for the refreshment of Members.
This GHC 12,000 is meant to be spent at four sittings.
Meanwhile, the General Assembly has had three sittings already.
With this ruling, a new budgetary allocation must be made for the refreshment of General Assembly Members.
UGSRC: Ampem Owusu Adjei elected as GA Speaker
Emmanuel Ampem Owusu Adjei was elected Speaker of the General Assembly of the University of Ghana Student Representative Council at its first meeting on Friday, September 20.
He beat his only contender in the race, Kwaku Asante Bismark, by just 6 votes to land the SRC’s top legislative job after securing a total of 84 out the 163 votes cast.
The ruling on the case was on Tuesday, October 18, 2019.
