One of the disqualified Organizing Secretary aspirants in the Ghana Institute of Journalism Students Representative Council (GIJ-SRC) elections, Cedric Afewu, has filed an application for an order of interlocutory injunction to restrain the SRC Electoral Commission from proceeding with the organization of the 2019 SRC elections.
According to Afewu, the EC’s decision to disqualify him from the race “is not justifiable and is unlawful”
Cedric Afewu is one of the two Organizing Secretary aspirants who was declared unqualified by the Electoral Commission.
The Electoral Commission, chaired by Isaac Adu, explained that Cedric was disqualified because he failed to meet the constitutional mandate of serving the SRC for at least 6-months; an explanation Cedric’s legal counsel describes as not factual.
In an EC communique stating the varied reasons for disqualifying some aspirants in the SRC race, they mentioned, in the case of Cedric that only Presidents of Halls and Clubs were constitutionally recognized as serving the SRC.
However, Cedric’s legal counsel is arguing that Cedric, an executive of the Mandela Hall, is recognized by the General Assembly of the SRC as the “Hall’s nominee to the House and has been duly sworn in for the matter.”
They add that the General Assembly “has consistently had precedence to back the fact that in some instances, Hall Presidents do make delegation of sending a representative to General Assembly Permanently and are duly recognized as service”
It is the case of Cedric Afewu that, in the event that his claim in this action is upheld, his earlier disqualification will be declared null and void.
Also, an order to nullify the sale of nomination forms to aspirants for the position of Organizing Secretary and monies refunded back to students who have already picked forms during the reopening of nominations.
The case is set to heard later today at 11am.
UniversNews understands that the only disqualified General Secretary aspirant in the SRC race, Richmond Bediako Mortty has also filed an application for an order of interlocutory injunction on all electoral processes by the Electoral Commission.
